Agreement to Terms

These Terms of Use form a legally binding agreement between you (whether individually or representing an entity) and Prime Golf Carts LLC, doing business as Prime Golf Carts, regarding access to and use of the Prime Golf Carts website and related platforms. By accessing the Site, you confirm that you have read, understood, and agree to be bound by these Terms.

IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right to modify these Terms at any time. Updates will be noted by changing the "Last updated" date. Continued use of the Site following any modifications constitutes your acceptance of the revised Terms. These Terms apply to users within the United States. The Site is intended for users 18 and older.

Intellectual Property Rights

All content on the Site — including source code, databases, software, designs, audio, video, text, photographs, and graphics — along with trademarks, service marks, and logos, are owned or licensed by Prime Golf Carts and protected by copyright and trademark laws. Content is provided "AS IS" for personal, non-commercial use only. You may not copy, reproduce, republish, or exploit any Site content for commercial purposes without express written permission.

User Representations

By using the Site, you represent and warrant that you have legal capacity to agree to these Terms, are not a minor in your jurisdiction, will not access the Site through automated or non-human means, will not use the Site for illegal or unauthorized purposes, and will comply with all applicable laws and regulations.

Prohibited Activities

You may not use the Site to: systematically retrieve data; collect usernames or emails for unsolicited communications; create accounts through automated means; use the Site to advertise or sell goods/services without permission; circumvent security; engage in unauthorized framing or scraping; deceive or harass other users or staff; upload malware or tracking mechanisms; reverse-engineer Site software; impersonate other users; or use the Site in violation of applicable law.

User-Generated Contributions

If the Site invites user participation (e.g., reviews, comments), you represent that your contributions do not infringe third-party rights, are accurate, are not unsolicited advertising, and comply with all applicable laws. By posting Contributions, you grant Prime Golf Carts an unrestricted, irrevocable, perpetual, worldwide license to host, use, display, and distribute your content for any purpose, including commercial uses. Prime Golf Carts may remove Contributions at its discretion.

Reviews

If you post a review, you must have firsthand experience with the product or service, avoid offensive language, avoid discriminatory references, not be a competitor, and post truthful statements. Prime Golf Carts may accept, reject, or remove reviews at its discretion.

Third-Party Websites & Content

The Site may contain links to third-party websites and content. Prime Golf Carts does not investigate, monitor, or verify third-party websites for accuracy or appropriateness, and we are not responsible for them or their privacy practices. Linking to third-party content does not imply endorsement.

Site Management

Prime Golf Carts reserves the right to monitor the Site for Terms violations, take legal action, refuse or restrict any contributions, remove content excessive in size or burdensome to systems, and otherwise manage the Site to protect rights and property.

Text Message (SMS) Terms

Program. Prime Golf Carts operates two text message programs: a transactional program (quote details, delivery and service scheduling, appointment reminders) and a marketing program (promotions, offers, new inventory announcements). You are enrolled in a program only if you check that program's opt-in box on one of our forms. Providing your phone number by itself does not enroll you.

Consent is not a condition of purchase. You are not required to agree to receive text messages in order to submit a form or to buy any goods or services from us. Marketing consent is optional and separate from transactional consent, and you may give one without the other.

Message frequency. Message frequency may vary. Message and data rates may apply — check with your mobile carrier.

Opt out. Reply STOP to unsubscribe at any time. Reply STOP to any message to stop receiving texts. You will receive a single confirmation message and no further messages unless you opt in again. You may also opt out by emailing sales@primegolfcartsusa.com or calling (770) 649-3215.

Help. Reply HELP to any message, email sales@primegolfcartsusa.com, or call (770) 649-3215.

Carriers. Supported carriers include AT&T, Verizon Wireless, T-Mobile, US Cellular, and others. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your carrier and is not guaranteed.

Privacy. Mobile phone numbers and text messaging consent are never shared with third parties or affiliates for marketing or promotional purposes. See Section 7 of our Privacy Policy.

Privacy Policy

By using the Site, you agree to be bound by our Privacy Policy, which is incorporated into these Terms.

The Site is hosted in the United States. Users accessing from the European Union, Asia, or other regions consent to data transfer to and processing in the United States by continuing to use the Site.

Term and Termination

These Terms remain in full force while you use the Site. Prime Golf Carts reserves the right to deny Site access to any person at any time, without notice or liability.

Modifications and Interruptions

Prime Golf Carts reserves the right to change, modify, or remove Site contents at any time without notice. We cannot guarantee Site availability and are not liable for losses, damages, or inconvenience caused by Site unavailability.

Governing Law

These Terms are governed by Georgia law, applicable to agreements made and performed entirely within Georgia, without regard to conflict-of-law principles.

Dispute Resolution

If the parties cannot resolve disputes through informal negotiation, disputes (with limited exceptions) will be finally and exclusively resolved by binding arbitration under the American Arbitration Association (AAA) Commercial Arbitration Rules. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL.

Arbitration will take place in Fulton County, Georgia, unless otherwise required. Class actions are not permitted. Disputes regarding intellectual property, unauthorized use, or claims for injunctive relief are excluded from binding arbitration.

Disclaimer

THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. To the fullest extent permitted by law, Prime Golf Carts disclaims all warranties, express or implied.

Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES. Prime Golf Carts' liability is limited to the amount you have paid to us.

Indemnification

You agree to defend, indemnify, and hold harmless Prime Golf Carts, its subsidiaries, affiliates, and their officers, agents, partners, and employees from any loss, damage, liability, or claim arising from your contributions, Site use, breach of these Terms, breach of representations, violation of third-party rights, or harmful acts toward other users.

Electronic Communications

Site visits, emails, and online forms constitute electronic communications. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS.

California Users and Residents
